Essentials Webinar
Series
Beginning in January 2010, BLS
will offer a free weekly webinar series presented by each of the 12
BLS standing committees. The series is available to all BLS members
and will take place on Wednesdays from noon to one beginning on
January 13 and continuing every
Wednesday at noon through the end of March 2010. Here is what you

January 13: The Agribusiness Committee presents:
“Essentials of IP in Business Law.”

This program will cover the basics of intellectual property, as
well as, recent developments in the area as they intersect with the
practice of business law and the practice areas of the various
Standing Committees. The focus will be on patents, trademarks, and
trade secrets, with a brief explanation of copyright law. The
program seeks to impart a flavor for the major issues and
foundational concepts of intellectual property law as often
encountered in the context of daily business practice.

January 20: The Consumer Financial Services
Committee presents: “Essentials of the New Consumer Financial
Protection Laws: What They Mean For Your Law Practice.”

Probably no area of law is changing more rapidly than consumer
financial protection. Mortgage reform legislation, on both the
state and federal level, has significantly altered the rights of
lenders and homeowners, and created new risks for the lawyers who
represent them. New statutes and rules govern credit and debit
cards, overdrafts in deposit accounts, and stored value products
such as gift cards and payroll cards. The Wall Street Reform bill
passed by the House of Representatives would create a new Consumer
Financial Protection Agency to regulate a broad range of financial
services, including national and state-chartered banks, finance
companies, mortgage brokers, money remitters, and a host of other
businesses. Many expect rules requiring use of “plain
language”, restrictions on the use of arbitration clauses,
and other significant changes in consumer contracts.
Three speakers will discuss these changes: Arnold S. Rosenberg, Assistant Dean of Thomas
Jefferson School of Law, San Diego, Chair of the State Bar Consumer
Financial Services Committee and Director of Thomas
Jefferson’s online LL.M. program in Financial Services; Julia L. Greenfield of Irvine,
Committee Vice-Chair and a prominent expert on mortgage lending and
loan modification; and Daniel J.
O’Rielly of O’Rielly & Roche, San Francisco,
author of the Consumer Finance Litigation blog

January 27: The Cyberspace Law Committee presents:
“Essentials of Cyberspace Law: User-Generated Content,
Privacy, and Advertising.”

In the brave new world on your desktop, laptop and cell phone,
current legal principles are being developed bit by byte. The
ability to share content, broadcast to friends (and enemies) and
gather behavioral data require creative approaches to applying
existing laws, and to creating new laws. Because of the growth of
social networking, issues surrounding user content, and privacy
protection are on the rise. The pervasiveness of online commerce
has prompted advertisers to exploit new data gathering
capabilities. This program, featuring members of the Cyberspace Law
Committee, will provide a basic introduction to the laws in these
areas, and discuss the gray areas and future developments that will
keep our virtual lives interesting for some time.

Denis T. Rice Receives
Lifetime Achievement Award: Since 1997, the Business Law
Section has conveyed its annual Lifetime
Achievement Award to a deserving person who is honored during
the Business Law Breakfast at the State Bar Annual
Meeting. This year's recipient wasDenis T. Rice. The breakfast
took place on Friday, September 11,
2009 in San Diegot.
